These Terms and Conditions ("Agreement") govern your use of the subscription fitness program and home gym equipment rental services provided by Vitality S&A, LLC ("we," "our," or "us"). By subscribing to our fitness program and/or renting home gym equipment, you agree to comply with and be bound by the following terms.
1. Subscription Program 1.1 Program Description - We offer a subscription-based fitness program that provides access to online training, fitness classes, and workout plans. 1.2 Subscription Plans - Subscriptions are available in monthly plans. Subscription fees will be charged on a recurring basis, according to the selected plan. You may upgrade or downgrade your subscription plan by contacting us or adjusting your account settings. Any changes will take effect at the beginning of the next billing cycle. 1.3 Billing and Payments - Subscription fees are due at the beginning of each billing period and will be automatically charged to the payment method on file. If payment is not received by the due date, we reserve the right to suspend your access to the program until the outstanding payment is made and to pick up the rented equipment at our earliest convenience. You are responsible for maintaining accurate billing information. 1.4 Cancellation - You may cancel your subscription at any time by providing written notice or by canceling through your account. No refunds will be issued for partial months or unused portions of the subscription period. Upon cancellation, you will retain access to the program until the end of your current billing period.
2. Home Gym Equipment Rental 2.1 Rental Agreement - We offer rental services for home gym equipment, including but not limited to weights, treadmills, rowers, and exercise bikes. Rental periods are available in monthly increments. A setup and delivery fee is required prior to delivery of the equipment. 2.2 Delivery and Setup - We will arrange for delivery and setup of the rented equipment at your designated location. Additional fees may apply for delivery and exchanges. You are responsible for ensuring that the delivery location is suitable for the equipment. Equipment must be placed on a concrete floor or floor with proper load support. If flooring is not adequate we reserve the right to refuse equipment drop off and delivery fees will still be assessed. Equipment rental plans only available to customers located within 50 miles of Greensboro, NC 2.3 Equipment Care and Use - You agree to use the equipment only for its intended purposes and in a manner that complies with all safety guidelines. You are responsible for maintaining the equipment in good working condition and reporting any issues to us immediately. You may not modify, disassemble, or sublet the equipment. 2.4 Return of Equipment - At the end of the rental period, you must return the equipment in the same condition as it was delivered, normal wear and tear excepted. If equipment is damaged beyond normal wear and tear or not returned, you may be charged for repairs or replacement. 2.5 Early Termination - If you wish to terminate your rental agreement before the end of the rental period, you may do so by providing written notice or notifying us through your account. Early termination fees may apply.
3. Liability and Disclaimer 3.1 Assumption of Risk - By participating in the fitness program and using rented equipment, you acknowledge that physical exercise carries inherent risks, including the risk of injury. You assume full responsibility for any injuries or damages that occur to you or anyone else during your participation in the program or use of the equipment. 3.2 Limitation of Liability - We are not liable for any injuries, damages, or losses arising from your participation in the fitness program or use of the rental equipment. We are not liable for any injuries, damages, or losses to any other individual using rented equipment while in your possession.
4. Account Responsibilities - You are responsible for maintaining the confidentiality of your account login credentials. You must notify us immediately if you suspect any unauthorized use of your account .
5. Privacy - We are committed to protecting your privacy. Please refer to our Privacy Policy for details on how we collect, use, and protect your personal information.
6. Termination - We reserve the right to terminate or suspend your subscription or rental agreement for violations of this Agreement, non-payment, or misuse of the program or equipment.
7. Changes to Terms and Conditions - We reserve the right to modify these Terms and Conditions at any time. Any changes will be communicated to you, and continued use of our services constitutes acceptance of the revised terms.
8. Governing Law - These Terms and Conditions shall be governed by and construed in accordance with the laws of North Carolina, USA, without regard to its conflict of law principles.
